WHAT IS ARBITRATION?
If all else fails in the course of negotiation or mediation, there may still be the option of Arbitration. An Arbitration is essentially a private adjudication-like process. It can be defined and designed by the parties in terms of how they wish to have their differences resolved. This could include the provisions of Facilitated Negotiation or Mediation. Similarly, a Mediation can be adapted to include Arbitration.
Unbeknownst to most persons, arbitration provisions are frequently part of their day to day personal and business transactions, or of the law governing a given personal or business activity. Often parties to a dispute need only to avail themselves of the opportunities and advantages of arbitration to settle a dispute; beit in their personal or business relationships. Arbitrations are subject to Arbitration Legislation.
